General Conditions
- You agree that the following Terms and Conditions constitute a legally binding agreement between you (herinafter "USER") and Incredible Things Department GbR (hereinafter the "Incredible Things Department") in relation to your use of Incredible Things Department’s Internet platforms at www.srndty.com, surroundies.com, surroundity.com, surrounditi.es (hereinafter “Websites”) and any services that Incredible Things Department provides through its Websites (hereinafter “Services”). You represent and warrant to Incredible Things Department that you have read and understood the Terms and Conditions, and that you have the legal capacity to enter into this Agreement.
- Incredible Things Department reserves the right to update and change the Terms of Service from time to time without notice. Continued use of the Service after any such changes shall constitute your consent to such changes. The last date of modification will always be provided with the Terms & Conditions.
- The USER's use of the Service is at his/her own sole risk. The service is provided on an "as is" and "as available" basis.
- The USER agrees not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service or Content within the service.
- Content uploaded by the USER is not pre-screened, but Incredible Things Department has the right in their sole discretion to refuse or remove any Content that is available via the Service.
- Incredible Things Department does not guarantee that the Service will be uninterrupted, timely, secure, or error-free, despite all efforts to provide such a Service.
User Accounts
- The USER may not use the Service and/or their for any illegal or unauthorized purpose.
- Incredible Things Department reserves the right to suspend or delete USER accounts for whatever reason at whatever time with or without notice.
User Generated Content
- Incredible Things Department assumes no responsibility or liability which may arise from the Content of Incredible Things Department’s Websites and Services, including, but not limited to, claims for libel, slander, defamation, invasion of privacy and publicity rights, pornography, obscenity, fraud, or misrepresentation.
- Incredible Things Department reserves the right, but is not obligated, to remove, block or delete any Content of any type, if Incredible Things Department it it's sole discretion deem said Content to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
Copyright and Content Ownership
- Incredible Things Department assumes no responsibility for liability for any Content created by the USER on Incredible Things Department's Website and Service.
- Incredible Things Department does not claim any ownership rights on Content, visual or textual created by the user on Incredible Things Department's Website and Service.
- The USER expressly acknowledges and agrees that the USER him-/herself, and not Incredible Things Department, is fully responsible for all Content that the USER uploads, posts, e-mails, transmits or otherwise makes available through Incredible Things Department’s Website or Services.
- The USER acknowledges that Content uploaded to, or transmitted through Incredible Things Department’s Website or Services may be protected by copyrights, trademarks, service marks, patents or other intellectual property rights and laws. USER must not upload, display, send, transmit or otherwise make available any Content in which USER does not have the appropriate rights to do so. Unauthorized copying, distribution, modification, display, public performance or other unauthorized use of copyrighted works by USER may constitute an infringement of the copyright holders' rights and may result in civil litigation and criminal prosecution.
